Les infraccions penals en matèria se seguretat vial (arts. 379-385 del Codi Penal), constitueixen un dels grups de delictes que més interès teòric i pràctic desperten en la doctrina i en la jurisprudència. Aquest interès s’ha vist augmentat encara més degut, especialment, a les reformes operades per mitjà de la LO 15/2003, LO 15/2007, LO 5/2010 i LO 2/2019.
Aquestes reformes han estat la conseqüència lògica de l’interès mediàtic que suscita la denominada “delinqüència vial” essent un dels temes “estrella” de l’agenda política. Hem passat, en un espai de temps relativament curt, d’una certa habituació social als accidents de tràfic, a una actitud de tolerància zero i de lluita decidida contra els infractors vials.
Delictes tals com la conducció sota els efectes de l’alcoholo de les drogues, la conducció temerària, la conducció sense permís o llicència per pèrdua total de punts, etc., han vist endurides les penes de manera considerable en virtut de les reformes legals esmentades.
